1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the TestCopilot service ("Service") provided by TESTCOPILOT LTD ("we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

TestCopilot is a static analysis tool for Cypress test files that helps identify:

  • Race conditions and timing issues
  • Code quality problems
  • Brittle test patterns
  • Missing assertions and best practice violations

The Service is provided via web interface, CLI tool, and VS Code extension.

3. User Accounts

3.1 Account Creation

You may create an account by providing a valid email address. You are responsible for maintaining the security of your account.

3.2 Anonymous Usage

Anonymous users may use the Service with rate limits applied (currently 3 analyses per hour).

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior.

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to circumvent rate limits or security measures
  • Upload malicious code or harmful content
  • Reverse engineer or attempt to extract source code
  • Use the Service to create competing products
  • Share your account credentials with others
  • Automate requests to abuse the Service
  • Upload files you do not have rights to analyze

5. Intellectual Property

5.1 Our Rights

The Service, including all software, algorithms, and documentation, is owned by TESTCOPILOT LTD and protected by copyright and other intellectual property laws.

5.2 Your Content

You retain all rights to code and files you upload. We do not claim ownership of your content. Uploaded files are processed temporarily and deleted immediately after analysis.

5.3 License Grant

We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes.

6. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.

7. Service Availability

We strive to provide reliable service but do not guarantee:

  • Uninterrupted or error-free operation
  • That defects will be corrected immediately
  • That the Service will meet your specific requirements
  • Availability during maintenance or updates

We reserve the right to modify or discontinue the Service at any time with reasonable notice.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "AS IS" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid us in the past 12 months (if any)
  • We are not responsible for decisions made based on analysis results
  • You are responsible for backing up your own code and data

9. Indemnification

You agree to indemnify and hold harmless TESTCOPILOT LTD from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload to the Service

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via:

  • Email notification to registered users
  • Prominent notice on the Service
  • Updated "Last updated" date on this page

Continued use of the Service after changes constitutes acceptance of the new Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
